Prime Minister Chris Hipkins says he believes the Government should look at whether there should be further restrictions for people electronically monitored, after a 鈥渄amning鈥 police internal report.听
The report,, says criminals are 鈥渞egularly鈥 exploiting a 鈥渟ignificant vulnerability鈥 by wrapping tinfoil around their ankle bracelets and going on to re-offend.听
Examples of the practice, known as foiling, include a Canterbury man leaving his home undetected and allegedly going to his ex-partner鈥檚 where he lay in wait and held her against her will, assaulting her multiple times, threatening to kill her and attempting to stab her.听
Youths have also been foiling their bracelets before doing ram raids and smash and grabs.听

The police risk assessment report, EM Bail - 鈥淔oiling鈥 and Monitoring Limitations, says public safety will continue to be compromised because of a 鈥渃ombination of heightened demand and systemic monitoring limitations鈥.听
The electronic monitoring (EM) regime for community-based offenders and bailees was 鈥渆asily circumvented by motivated individuals鈥, through foiling, it says.听
鈥淭he public and judiciary are likely of the opinion that offenders on EM are closely monitored at all times, this cannot confidently be assured by the current system.鈥听
On Tuesday, the Prime Minister was asked about the report on听The Mike Hosking Breakfast听in relation to the 48 people facing charges for homicide-related offences on EM bail.听
鈥淯ltimately that鈥檚 a question for the judges who have agreed to that. I do think there are some emerging findings out of听听that happened a few weeks ago that the Government will look closely at,鈥 he told听The Mike Hosking Breakfast.听
鈥淚鈥檓 certainly not saying that I鈥檓 completely comfortable with having violent offenders on electronically monitored home detention 鈥 and I think that we should look at whether there should be further restrictions there but those are reviews that are under way at the moment.鈥听
Hipkins said the number of people who were on EM bail had gone up 鈥渟ignificantly鈥.听
鈥淚 don鈥檛 think that鈥檚 necessarily a bad thing but we should be looking at whether in fact it鈥檚 appropriate for all of those offenders.鈥听
Asked when he would act on concerns, Hipkins told听The Mike Hosking Breakfast听when you have reviews under way, you wait to see what the outcomes of the reviews are before making any further decisions.听
鈥淚t will ultimately be for the next Parliament, the Parliament after the election because Parliament finishes this week but it鈥檚 certainly something we will be looking very closely at.鈥听
On Monday, a spokesman for Corrections Minister Kelvin Davis told the听Herald听he had 鈥渞eiterated鈥 to Corrections his expectation that 鈥渁ll breaches of electronic monitoring are dealt with and responded to as quickly as possible鈥.听
Davis would wait to see what the review following the double-shooting in Auckland involving Matu Reid, which would look at electronic monitoring, recommends before making any comment about whether a review was needed.听
New Zealand Parole Board chair Sir Ron Young told the听Herald听the most important consideration for the board was 鈥渃ommunity safety鈥.听
鈥淎 monitoring device is an important tool the Parole Board can require as part of the offender鈥檚 special conditions of release to support their curfew or for victim protection.鈥听
The board understood that the Department of Corrections was able to identify attempts by an offender to tamper with a monitoring device, including foiling.听
鈥淚t is the Parole Board鈥檚 expectation that any alerts of this kind will be treated as a priority by the department and immediately investigated.鈥听
The police report provides a breakdown of some of the country鈥檚 EM bail population.听
There are 48 people on EM bail accused of 鈥渉omicide and related offences鈥.听
There are also 70 accused of kidnapping and abduction, 131 robbery, 465 grievous assaults, 211 serious assaults, 64 sexual offending, 211 burglary and car conversions and 179 firearms offences.听
The report says there were 132 EM bailees nationwide who 鈥減ose a current staff safety risk as assessed under the Tactical Response Model鈥.听
The report also provides a breakdown of EM bail breaches, by district in the 2022/23 financial year.听
Counties Manukau, which has 21 per cent of the country鈥檚 EM bailees, led the country with 3699 bail breach incidents. Auckland City had 1807, Waitemat膩 1457, Wellington 904 and Canterbury 845.听
On Monday, Police Assistant Commissioner Naila Hassan told听The Mike Hosking Breakfast听that 鈥減roportionately鈥 the number of people breaching EM bail was no different in terms of a percentage as it was five or six years ago.听
鈥淭he difference is there is a whole lot of more people on EM bail now,鈥 she said.听
鈥淚t鈥檚 a more demanding problem for us today than it was six years ago because of the volume.鈥听
Appearing on听九一星空无限hub鈥檚 The AM Show听Hassan said the report was an 鈥渋nternal intelligence product鈥.听
鈥淚t wasn鈥檛 a report for an external audience and on that basis we produce intelligence products for our people to identify emerging risk and for us to respond to that accordingly.鈥听

鈥淚鈥檓 very concerned about it,鈥 he said, adding he did not have confidence in the current system given the increase in people out on EM bail along with an increase in those absconding.听
鈥淭hey鈥檙e swamped, they鈥檙e completely totally overwhelmed. Corrections service is still well down on numbers and so all of them are just fighting to keep their heads above water.鈥听

鈥楴ot fit for purpose鈥: Victim advocate not surprised听
High-profile victim advocate Ruth Money told the听Herald on Sunday听she was not surprised by what the report said.听
鈥淓verybody in the system has known that EM bail is flawed, but they continue to use it.听
鈥淚鈥檓 really concerned from a community safety perspective but I guess that鈥檚 the reality of what I do every day. I鈥檓 shocked and disappointed, I鈥檓 actually thankful that police put that in writing so that then hopefully there鈥檚 some pressure that can change the system because it鈥檚 clearly not fit for purpose.鈥听
People were 鈥渢errified鈥, she said; however, there appeared to be a push for people to end up on EM bail.听

鈥淚t鈥檚 just not fit for purpose.鈥听
鈥淭here certainly needs to be more resourcing because we鈥檝e known for years, that as much as people think and the system wants us to think that it is monitored well with constant eyes, like real-time eyes on it, that鈥檚 just simply not the case and I guess this report shows that, or reinforces that.鈥听
Money said there needed to be a process where someone had to earn EM bail, and disagreed victims鈥 considerations were taken into account when EM bail was considered.听
鈥淢ore often than not it鈥檚 the victims who know the offender, so victims are saying he will or she will do this, and people don鈥檛 take that seriously so they whack on a bracelet and the person absconds and harms them again,鈥 she said.听
鈥淚f you can wrap a bit of tinfoil around it, what is the point of having an EM bail system? It鈥檚 absolutely pointless and you鈥檙e going to have to incarcerate them, it鈥檚 as simple as that.鈥听

鈥淚 think the report is honest, which you don鈥檛 often see out of government-funded departments, and for that I鈥檓 thankful. But it鈥檚 not surprising.鈥听
