Former prison guard David Benbow was yesterday found guilty of killing his childhood friend Mike McGrath. No body or weapon has ever been found. His estranged partner Joanna Green, who had just left Benbow and started seeing McGrath, emerged as a key witness in the high-profile trial and subsequent retrial. Kurt Bayer reports on a love triangle that ended in murder.听
The day she thought 鈥渢his is it鈥 and finally moved out, Joanna Green rang Mike. Michael McGrath, the ever-dependable family friend, the skilful carpenter who had built their kids鈥 playhouse and elaborate, sweeping deck. The 鈥渓ovely, lovely man鈥, good-looking too, who always cared about her and her children.听
She knew Dave Benbow - her partner of 17 years - wouldn鈥檛 take this well. So, she needed help.听
Turning off the CCTV cameras at their lifestyle block on the southern fringes of Christchurch, which Benbow 鈥渙bsessed鈥 over, she was emotional. She was leaving a 鈥渢oxic鈥 relationship, one she couldn鈥檛 handle anymore, her and the kids鈥 stuff piled up in the trailer.听
At the end of the driveway, she would joke to McGrath that they should 鈥渉ave a snog鈥.听
They didn鈥檛. But within weeks, they would. And then, he would vanish.听
She would immediately ring Benbow.听
鈥淲hat have you done with him?鈥听

It would take two years for Benbow to be arrested and charged with McGrath鈥檚 murder.听

At the High Court in Christchurch this year,听at an initial trial that ended in a hung jury, and then a retrial which ended this week, the Crown alleged that Benbow lured McGrath to his semi-rural lifestyle property in Halswell on Monday, May 22, 2017. It claimed he used his .22 semi-automatic rifle 鈥 which has also since disappeared - with suppressor and sub-sonic ammunition, to shoot him dead and then dispose of his body, just weeks after learning he was seeing Green and telling a counsellor he wanted to 鈥渁nnihilate鈥 him.听
Green gave evidence at both trials.听
She explained what led to her taking their two children and walking out on March 3, 2017 鈥 two months before McGrath鈥檚 disappearance.听
Christchurch builder Michael Craig McGrath, 49, was last seen at his home in Halswell, Christchurch, in May 2017.听
She claimed Benbow had controlled all of their finances and bank accounts, saying he鈥檇 been obsessed with property and money.听
鈥淥ur family came second to money,鈥 Green told the court.听
In February 2017, she told Benbow she 鈥渃an鈥檛 do it anymore鈥 and wanted him to move out. He refused.听
So on March 3, 2017, without telling her partner, she organised to leave.听
McGrath, whom she had known for the last 17 years and whom she always thought highly of, volunteered to help.听
鈥淗e said, 鈥業鈥檇 do anything for you bar rob a bank鈥,鈥 Green told the court.听
On the day she moved out, she made a phone call to police, saying she had 鈥渘o idea how [Benbow] would react鈥 and wanted to be 鈥渃overing my bases鈥 and have a record that she was leaving a 鈥渢oxic relationship鈥.听
Afterwards, she felt 鈥渟o relieved鈥 and although nothing had happened between her and McGrath before then, she now felt she could act on her feelings towards him.听

鈥淚鈥檝e always adored him and respected him and now I had a chance of getting the icing on the cake,鈥 she said.听
鈥淗e was just such a good man and the opportunity came along.听
鈥淚 asked him if he would teach me how to kiss and be touched. I trusted him that much.鈥听
They discussed whether it would ruin their friendship but McGrath told her: 鈥淵ou could be my soulmate鈥.听
鈥淗e was a good-looking man and very kind. We got on so well. He was a lovely, lovely man. He cared about me and my children and our welfare,鈥 Green said.听
Once together, McGrath would come for tea or bike over once her children were in bed.听
Green didn鈥檛 want the kids or Benbow to know she was seeing McGrath.听
鈥淲e didn鈥檛 want to hurt anyone. I didn鈥檛 want to hurt Dave. It was none of his business but he also didn鈥檛 need to be hurt by that,鈥 she said.听
But one of her children saw McGrath and her kissing and told Benbow.听

He later sent her a handwritten letter where he told her he still loved her and that he was now feeling 鈥渧ery lonely and lost鈥.听
Benbow apologised for the way things ended and wished her all the best.听
It left Green concerned for him, which she felt was out of character for 鈥渁 very strong man鈥 that she thought was emotionally unwell.听
She contacted police and raised concerns that Benbow had a firearm and she didn鈥檛 want him to hurt himself.听
On May 22, the day that McGrath vanished, teacher aide Green went to work as usual but couldn鈥檛 get hold of him.听
She tried ringing him 22 times.听
鈥淚 just kept trying and trying and trying to get a hold of him. I was really concerned.鈥听
Green kept trying the next day without success.听
She waited for the evening and phoned McGrath鈥檚 mother Adrienne at 6.38pm to see if he鈥檇 showed up for his usual weekly dinner at her place.听
Green rushed around to McGrath鈥檚 mother鈥檚 house in Halswell, saying, by then she had 鈥渞ed flags鈥.听
She tried phoning Benbow to see if he knew anything and eventually spoke to him.听
鈥淚 said, 鈥榃hat have you done with him? Where is he?鈥欌 she said.听
鈥淗e said, 鈥楲ook, I haven鈥檛 done anything鈥.鈥听
After going to McGrath鈥檚 house with his brother Simon and not finding him home, she phoned police to report him missing.听
The call was replayed to the jury and was heard saying: 鈥淚 am thinking that he has hurt Mike.鈥听
After a years-long police investigation,听two trials, with dozens of witnesses, the jury agreed.听
