
A doctor is alleged to have become 鈥渙bsessive and extremely possessive鈥 with a woman he met on a sexual website and went on to have sex with her at his workplace after taking a swab from her.
The doctor and the married woman, known as Ms G, are said to have met on the website before meeting up in person at a bar and agreeing to pursue a sexual, yet secret, relationship.
That relationship related to a sexual fetish and involved the doctor acting as the 鈥渄om鈥, or dominant partner, and the woman the 鈥渟ub鈥, or submissive partner.
Now the doctor is before the Health Practitioner Disciplinary Tribunal, which has imposed heavy suppressions on the case, including anything that identifies the doctor or the woman.
Outlining the case for the tribunal this morning, Dr Jonathon Coates, of the Professional Conduct Committee, said while the sexual relationship was consensual, there was a 鈥渂lurring of boundaries鈥 between the doctor鈥檚 personal life and his professional life.
He鈥檚 alleged to have had sex with her at his workplace and later videoed her 鈥渟ubmitting鈥 to him.
He鈥檚 also alleged to have had her sign a contract about their sex life while at his workplace, provided health services to the woman at the same time that he was in a sexual relationship with her, and accessed lab results without authority or justification in 2018.
Coates submitted that the doctor鈥檚 actions warranted a finding of professional misconduct and that his negligence required sanction.
鈥業 remember having sex on the leather couch鈥
Giving evidence today, Ms G said after meeting at the doctor鈥檚 workplace in 2018, they walked to a pub and had a few drinks.
She said they talked about being safe 鈥渇rom an STI perspective鈥.
鈥淲e discussed that this was something that we were both careful about as we had both been in these relationships before.鈥
She mentioned she鈥檇 had an STI test recently, and the doctor asked to see it, so she took a screenshot and 鈥渕ight鈥 have sent it to him.
鈥淚 definitely never gave [doctor] permission either the first time or any time at all to look at any of my test results himself,鈥 she said.
The woman said she met the doctor at his premises on three or four occasions, once when they had sex on a couch in his office and another time when he carried out an examination and took a swab from her.
Coates put to her that the doctor refuted any sexual interactions happening at his workplace, but she was adamant.
鈥淚 remember having sex on the leather couch,鈥 before sharing some sexually explicit details, which helped remind her of the incident.
On a third occasion at his office, the woman claimed that the doctor wanted to video her 鈥渟ubmitting to him鈥.
That involved her 鈥済etting seated on my knees with my palms up鈥.
鈥淸Doctor] filmed me in this position in his office,鈥 she said.
She also performed a sex act on the doctor in his office as he sat at his desk, which he also denied.
鈥淗ow can you be sure that happened in the [premise]?鈥 Dr Coates asked.
鈥淏ecause I was the one that did it,鈥 she replied.
The pair also had sex at an Airbnb, and he also filmed himself 鈥渢ying me up and tying various knots鈥.
鈥淗e wore a mask so his face was not visible,鈥 she said.
The pair regularly messaged each other, and she also sent him videos, some sexual, of herself.
However, while she agreed to be filmed, she did not consent to him showing other people, she said.
鈥淸Doctor] knew that I didn鈥檛 want my husband or anyone else to find out.鈥
As for the swab, the woman said she mentioned she might have a vaginal 鈥渋mbalance鈥 or thrush, to which she claimed the doctor said something like, 鈥淚 can help you with that鈥 and 鈥渓et鈥檚 see what鈥檚 going on鈥.
The woman wasn鈥檛 keen for him to test her and felt pressured, but ultimately agreed.
鈥淚 felt I had to let him because he was being persistent.鈥
In the end, the woman said their relationship was 鈥渟hort-lived鈥 because he became 鈥渙bsessive and extremely possessive鈥.
It resulted in him emailing her, 鈥渁pologising unreservedly鈥 for his 鈥渁ntics鈥 days earlier at an event when he was 鈥渄runk, upset or angry鈥.
鈥淚 had no right to show [another woman] that video, and I can promise that it will never happen again,鈥 he said.
When asked by Coates how drunk he was, the woman said, 鈥淵ep, he was drunk, quite drunk, and then it got worse as the night went on鈥.
She said that night he 鈥渇lipped out, and lost his mind鈥 because she didn鈥檛 go to an event.
The next morning, she got a message from an associate who said the doctor had shown her a sexual video with her in it.
鈥淚 was concerned that [doctor] is going around telling people about our relationship and showing messages about myself to other people.鈥
鈥榊ou just want to destroy him鈥
The doctor鈥檚 counsel, Harry Waalkens, put to her that she had asked the doctor to take the swab as she was worried that if she got her own GP to do it, he might think 鈥渢hat you had been elsewhere鈥.
鈥淣o, I trust my doctor. I don鈥檛 think he would share my information with my husband, it鈥檚 confidential.鈥
He put to her that she 鈥渉ad it in鈥 for the doctor and that she wanted to 鈥渄estroy鈥 him.
鈥淔or what reason?鈥 she replied. 鈥淚 don鈥檛 want to destroy anybody.鈥
Waalkens asked why she wasn鈥檛 willing to accept that the doctor was simply 鈥渨anting to help鈥 by doing the swab for her.
鈥淚 just wanted him to leave me alone,鈥 she said.
Waalkens asked, 鈥淲hat on earth鈥 she wanted out of the relationship.
The woman said her marriage 鈥渨asn鈥檛 very healthy鈥, and she wanted 鈥渟omething that was not mundane in my normal day to day life鈥.
He also put to her that her relationship with the doctor 鈥渨as entirely a personal one鈥.
鈥淵ou didn鈥檛, at any time, regard him as your doctor,鈥 he asked.
鈥淣辞.鈥
鈥淚s it true to say that when you first met up with [doctor], you didn鈥檛 know he was a doctor?鈥 he asked.
鈥淣o [I didn鈥檛],鈥 the woman replied.
However, in re-examination by Dr Coates, she confirmed that she knew he was a doctor when he took a swab from her and prescribed antibiotics.
