
A Ponsonby CEO embroiled in an听alleged road rage incident听involving a hearing- and sight-impaired pensioner and high-performance European sports car has been charged with criminal offending and is set to appear in court.听
But his alleged victim 鈥 a 74-year-old man who suffered听suspected concussion, scrapes, bruising and a likely torn hamstring 鈥 has also been charged and now faces the justice system alongside the wealthy businessman 38 years his junior.听
Both men face one count of fighting in a public place over the August 11 incident at听Silverdale. The CEO, who is 36, has also been charged with dangerous driving involving a $430,000听luxury supercar.听
They are both proclaiming their innocence and blame the other for the听violent altercation.听
The pensioner鈥檚 family say they are stunned the retired mechanic and grandfather, described as a 鈥済entle soul鈥, has been charged by police and plan to defend the matter in court.听
It鈥檚 understood lawyers are now working pro bono on the elderly man鈥檚 defence and trying to have his charge withdrawn.听
鈥淭he terrible events that unfolded on that Sunday afternoon have left us all deeply mortified,鈥 a family statement says.听
鈥淲e never imagined something like this could happen to an honest family man who wouldn鈥檛 hurt a fly.听
鈥淥ur father has worked hard his whole life, kept his record clean, and helped and supported the community. He鈥檚 earned the right to enjoy a peaceful retirement.鈥听
The pensioner claims he was set upon by the CEO after an alleged road rage incident on the听Northern Motorway, and that he was repeatedly punched about the head and body before falling to the ground where he was allegedly kicked or stomped.听
A doctor鈥檚 report noted suspected concussion, muscular injuries and a 鈥渓arge hematoma鈥, along with bruises and scrapes.听

The man鈥檚 family said his physical and mental well-being had suffered immensely since the incident.听
He was now unable to enjoy his favourite activities, like gardening, going to the gym and playing with his grandchildren.听
Relatives were 鈥渂affled鈥 at how a man of their father鈥檚 age and character could be caught up in a physical altercation with the much younger CEO and company director.听
鈥淭he family is horrified that such an incident could occur, and they find it utterly outrageous that he has been charged.鈥听
They felt the CEO should take responsibility for his alleged actions and seek help for anger issues, instead of 鈥渢rying to cover his tracks like a spoiled child鈥.听
The 74-year-old said he was punched "left and right to the head".听
The family also believed the CEO鈥檚 charges should be upgraded to reflect the extent of the pensioner鈥檚 injuries.听
However, the CEO told the Herald the pensioner was the one at fault.听
鈥淚 was assaulted by this gentleman,鈥 he alleged.听
Speaking yesterday, he thanked the听Herald听for offering him the chance to give his version of events, but declined to comment after speaking to his lawyer.听
鈥淚鈥檝e not been involved in this sort of situation before and I鈥檓 seeking some guidance.听
鈥淎s much as I wish to comment, the matter is currently before the courts, therefore I am not in a position to make any comment at this time.鈥听
He earlier said, 鈥渢here鈥檚 the possibility that I suffered injuries鈥 but would not elaborate while the incident remained under police investigation.听
Minor collision followed 鈥榯ailgating鈥 incident on Northern Motorway听
The pensioner told police he was attacked on the roadside at Highgate Parkway after being 鈥渢ailgated鈥 by the businessman鈥檚 luxury 2019 supercar.听
In a written statement to police, the pensioner said he was driving home north on SH1 when he noticed the sports car 鈥渦p my bum鈥 in the right-hand lane, trying to overtake.听
The man claimed the sports car then cut to his left-hand side, with the driver waving and gesticulating.听
鈥淢e thinking, 鈥榃hat a clown鈥, I did give him the one finger salute,鈥 the man wrote.听
Next, the sports car allegedly pulled in front of the elderly man鈥檚 Kia and slowed to about 60km/h, the pensioner claimed.听
He then felt a 鈥渂ump鈥 as the two vehicles collided before he exited the motorway at Millwater, followed by the sports car.听
The injured man's family say his activities have been curtailed since the incident.听
The man said he pulled over and walked towards the sports car saying, 鈥淵ou are so wrong鈥 when the driver allegedly 鈥渃harged at me鈥 and 鈥渟tarted to punch me left and right blows to the head鈥.听
The sports car driver allegedly pulled the older man鈥檚 sweatshirt over his head and threw him to the ground 鈥渨here he continued to rain down blows on my head and body鈥, the statement alleges.听
鈥淪tunned and disorientated鈥, the man got to his feet and 鈥渟taggered around鈥.听
He recalls saying, 鈥淵ou smashed my effing glasses鈥 before the sports car driver allegedly launched a second attack.听
鈥淗e once again threw me to the ground ... hitting me and I think some kicks or stomping.听
鈥淲hen it stopped I was completely disorientated and when I tried to get to my feet my left leg would not support me and I was staggering and close to passing out.鈥听
Police launch investigation into 鈥榓lleged assault鈥听
Police earlier told the Herald they were investigating an 鈥渁lleged assault鈥 about 3.30pm in Silverdale on August 11.听
鈥淧olice received a report of two vehicles involved in a minor collision, which resulted in both drivers pulling over and exiting their vehicles.听
鈥淎n altercation has occurred between occupants of both vehicles.鈥听
The drivers both left the scene but one later visited a medical centre with moderate injuries.听
In a statement this week, police confirmed both men had now been charged with fighting in a public place, and the CEO also faced a charge of dangerous driving.听
They will each make their first appearance in North Shore District Court later this month.听
