A fire that听killed Kelly Kemble Kerr and her 11-year-old son听in a Southland rental property with no working smoke alarms is now being 鈥渁ssessed鈥 by government investigators.听
The move has been welcomed by Kemble Kerr鈥檚 daughter who cannot stop thinking here mother and brother would still be alive if alarms had been in place and operating properly.听
鈥淚t鈥檚 been horrible... they could potentially still be alive right now,鈥 Jess Kemble told the听Herald.听
鈥淥ur lives and souls have been destroyed and we will never be the same again.听
鈥淭he memory and image of two caskets being buried on top of each other is something I will never forget... we don鈥檛 even have any of their belongings to remember them by, everything was lost.鈥听

On July 8, Fire and Emergency New Zealand announced its investigation into the fatal fire was 鈥渃omplete鈥.听
鈥淭he fire was caused by a heater coming into contact with flammable material, likely bedding,鈥 said Fenz district manager Julian Tohiariki.听
鈥淭he house had no working smoke alarms at the time of the fire.听
鈥淭his was a tragedy for the family and our thoughts are with them and the community of Manapouri at this difficult time.鈥听

The听Herald听can now reveal that the Ministry of Business, Innovation and Employment鈥檚 Tenancy Compliance and Investigations Team are taking a closer look at the tragic incident.听
TCIT national manager Brett Wilson explained the new assessment.听
鈥淲hile the TCIT has received no complaint or referral in relation to the property in Manapouri, a proactive assessment was initiated following previous media reporting to determine whether the rental is one to which the Residential Tenancies Act applies and, what evidence there is available with regards to smoke alarms at the property,鈥 he said.听
鈥淭he assessment remains in an early stage and queries have been initiated with Fenz.听
鈥淭his terrible accident demonstrates again how important it is to have working smoke alarms in all properties.鈥听

Under New Zealand law, working smoke alarms or detectors are compulsory in all rental homes.听
They must be installed within 3m of each bedroom door, or in every room where a person sleeps; and in each level of a multi-storey home听
All new smoke alarms must be photoelectric, have a battery life of at least eight years or be hard-wired, meet international standards and be installed according to manufacturer instructions.听
Existing smoke alarms do not need to be replaced if they are working and have not passed the expiry date.听
Landlords must ensure smoke alarms are working at the start of each new tenancy and remain in working order during the tenancy.听
If they fail to meet their obligations they can be subject to financial penalties of up to $7,200.听

Tenants must not damage, remove or disconnect smoke alarms; they must replace batteries on older devices when necessary and notify the landlord as soon as possible of of any problems.听
Kemble believed there were no smoke alarms in the house at all.听
She said her mother did not have a formal rental contract with the owner but a verbal agreement was in place and she paid rent.听
Kemble had planned to visit her family weeks before the fire but her plans changed.听
鈥淚 wasn鈥檛 there... I feel a lot of guilt about that,鈥 she said.听
鈥淚 could have helped them, I could have rescued them... saved them.听
鈥淚 have had people tell me I just have to accept it, that smoke alarms would not have helped or made a difference... but it could have, they could still be here right now.鈥听

Kemble wanted answers 鈥 and justice for her mother and brother.听
The owner of the property did not respond to messages from the听Herald.听
Kemble said he had not replied to her either.听
She said it had been 鈥減retty hard鈥 waiting for answers.听
The deaths have been referred to the Coroner. But the case will not progress until MBIE have completed their assessment 鈥 and any action that results from that.听
鈥淚 have nightmares, severe depression and panic attacks over the loss of my brother and mum,鈥 said Kemble.听
鈥淢ost nights I haven鈥檛 wanted to be living. I didn鈥檛 just lose one family member - we lost two in one of the most horrific ways possible.鈥听

Kemble Kerr had a heart condition which meant she could not move fast. Kelly had autism.听
Despite their challenges, Kemble said they were extremely close and had a good life.听
鈥淭hey did everything together,鈥 she said.听
鈥淭hey went vegan because they both just loved animals so much and they didn鈥檛 want to hurt any animals.听
鈥淢um had a rough life, she had eight children and already lost my sister when she was 9 months old, when I was about two.听
鈥淪he had a really hard upbringing, she had been to jail but she tried to do the best for us. She changed, Kelly was her everything and she was trying to make a better life.听
鈥淭hey were best friends... out of everyone in the world, they were the last two people who deserved this.鈥听
Kelly's sister says he is the biggest victim of the tragedy.听
Kemble cried when speaking about young Kelly.听
鈥淓veryone thinks their kid is the most amazing kid in the world but he genuinely was.听
鈥淗e was the most special, unique, intelligent, funny, smiley boy you could ever know.听
鈥淗e was kind, polite 鈥 he never swore.听
鈥淗e loved animation... Minecraft, drawing... one of his drawings was made into a stencil and put on his coffin.鈥听
Kemble said it was exhausting trying to get answers.听
鈥淚t takes a lot of energy and to be honest I don鈥檛 want to have to do it but it鈥檚 the only thing I can do for my mother and my brother,鈥 she said.听
